End User License Agreement

This End User License Agreement ("EULA") is a legal agreement between you ("User") and Script Depository / Amybeth Menendez ("we," "us," or "our") governing your use of all scripts, CEP panels, and Adobe Express add-ons made available through scriptdepository.com and its subdomains (collectively, the "Software"). By downloading, installing, or using any Software, you agree to be bound by the terms of this EULA.

Scripts and CEP panels provided free of charge through scriptdepository.com or the associated GitHub repositories are provided as-is, for personal and professional use. You are welcome to modify scripts for your own internal use, but may not redistribute modified versions without prior written permission.

4. Adobe Express Add-ons

Adobe Express add-ons distributed through the Adobe Express marketplace are also subject to Adobe's Marketplace Terms of Service. Your use of these add-ons must comply with both this EULA and Adobe's applicable terms. Add-ons that include credit-based or subscription pricing are subject to the specific pricing terms displayed at the point of purchase.

5. Intellectual Property

All Software, including source code, design, graphics, and documentation, is the exclusive intellectual property of Script Depository / Amybeth Menendez and is protected by applicable copyright and intellectual property laws. Nothing in this EULA transfers any intellectual property rights to you.

6. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR COMPATIBLE WITH ALL SYSTEMS OR VERSIONS OF ADOBE SOFTWARE.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SCRIPT DEPOSITORY OR AMYBETH MENENDEZ BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THIS EULA SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

8. Updates and Changes

We may update, modify, or discontinue any Software at any time without notice. We may also update this EULA from time to time. Continued use of the Software after any update to the EULA constitutes your acceptance of the revised terms. The updated date at the top of this page indicates when it was last revised.

9. Termination

This license is effective until terminated. Your rights under this EULA will terminate automatically and without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Software and destroy all copies in your possession.

This EULA shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising under this EULA shall be subject to the exclusive jurisdiction of the courts located in New York.
